Waiver Verbiage

RELEASE OF LIABILITY, ASSUMPTION OF RISK & MEDICAL WAIVER
 READ CAREFULLY — THIS WAIVER AFFECTS YOUR LEGAL RIGHTS.

The individual named below (“Participant,” “I,” or “me”) voluntarily desires to participate in activities provided by Dragon Axe LLC (the “Company”). In consideration for being permitted to participate, I agree to this Release of Liability, Assumption of Risk, and Medical Waiver (this “Release”).

Activities Covered: The “Activities” include axe and hatchet throwing, coach-approved knife throwing, specialty throwing implements, targets, lanes and spectator areas, instruction/demonstrations, practice throws, competitive play, and movement within the facility.

Assumption of Risk: I understand the Activities are inherently dangerous and may result in serious injury, permanent disability, death, or property damage. Risks include sharp/bladed implements, misthrows, rebounds/ricochets/deflections, equipment failure or misuse, slips/trips/falls, the actions of other participants or spectators, and my own physical condition, coordination, judgment, or conduct. I specifically acknowledge that knife throwing, when permitted, presents additional risks including unpredictable rotation, rebound hazards, and increased force. I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, including risks caused by the ordinary negligence of the Company or its staff, to the fullest extent permitted by Texas law.

Coach Authority & Safety Rules: I agree to follow all posted and verbal instructions and safety rules. I understand and agree that knife throwing is permitted only with coach approval, staff may restrict or stop participation at any time for safety reasons, failure to follow rules may result in immediate removal without refund, and participation while intoxicated or impaired by alcohol, drugs, or other substances is strictly prohibited.

Minors (Ages 8+): Participation is permitted only for individuals age eight (8) and older, and only after evaluation and approval by trained Dragon Axe coaches. Approval may be revoked at any time for safety reasons. If I am signing on behalf of a minor, I confirm I am the parent/legal guardian, have authority to sign, and expressly assume all risks on behalf of the minor, including risks related to the minor’s age, size, coordination, judgment, or conduct.

Release of Liability: I hereby waive, release, and forever discharge Dragon Axe LLC and its owners, managers, officers, employees, coaches, agents, members, affiliates, successors, and assigns (“Releasees”) from any and all claims, demands, causes of action, or liabilities of any kind, whether known or unknown, arising out of or related to my participation in the Activities, including claims based on the ordinary negligence of the Company or any Releasee. This Release does not apply to claims arising from gross negligence, willful misconduct, or liabilities that cannot be waived under Texas law.

Communicable Disease: I understand participation may expose me to communicable diseases or illnesses, and I voluntarily assume all risks related to such exposure.

Indemnification: I agree to defend, indemnify, and hold harmless the Company and Releasees from claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of my participation, my violation of this Release or Company rules, or claims brought by third parties related to my actions.

Medical Authorization & Insurance: I confirm I am in good physical condition to participate. I understand the Company does not provide medical insurance and I am responsible for all medical costs. I authorize the Company to obtain emergency medical treatment for me or the minor participant if deemed necessary.

Media Release: I grant Dragon Axe LLC permission to use my name, image, likeness, voice, or appearance in photos/recordings taken during the Activities for promotional purposes without compensation.

Governing Law & Venue: This Release is governed by Texas law. Any claim must be brought exclusively in the state or federal courts located in Collin County, Texas.
Entire Agreement: This Release is the entire agreement regarding participation. If any portion is unenforceable, the remaining sections remain in effect.

ACKNOWLEDGMENT: BY SIGNING BELOW, I CONFIRM I HAVE READ AND UNDERSTAND THIS RELEASE, THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS (INCLUDING THE RIGHT TO SUE), AND THAT I SIGN VOLUNTARILY.

In the event that the participant (14-17 years old) is under the age of consent (18 years of age), then this release must be signed by a parent or guardian. I (the below signed) hereby certify that I am the parent or guardian of the minor named below, and do hereby give my consent without reservation to the foregoing on behalf of this individual.
